Terms of ServiceThe following transaction is NOT refundable and cannot be cancelled.Clients are required to pay using PayPal in USD the full amount in advance, or 75% before and 25% after the sketch, or 50% before and 50% after the sketch.
(The percentages are of the commission's value) I reserve the right to refuse taking a commission for any reason.Clients are asked but not required to have the vision for how their commission would look like. However, clients are required to provide references before starting the work unless they are commissioning a thumbnail or the pose they have in mind is too rare/dynamic to find an exact reference of.For clients who are especially dubious and ask for numerous reworks (more than 3 full canvas-size reworks or equivalent) of the piece, a fee is issued at 20% of the commission during the sketching phase, and 40% of the commission at the final rendering phase.You’ll be receiving updates on the piece and are required to provide feedback on the progress (if you have nothing to add, a simple thumbs up emoji is enough).Once the piece is finished, you’ll have no chance to ask for changes and even if you do then little to no change may be made.In the cases where the client decides to advance the scale of the piece (adding a detailed background, changing the bust into a halfbody or fullbody, etc) ,the client will have to pay the difference before starting the work.Personal commissions will have my watermark (a small box with my name) which can only be removed by paying a small fee of $15Commercial commissions do not include this watermark thereby no fee is issued.I reserve my right as the artist to use the piece in my gallery, post on social media and even in my commission sheet and advertisements, and anywhere else that I deem fit (pfps included). I also reserve the right to share wips (work in progress shots) ,timelapses and other process insights.The above term also includes real time streaming of the art process on platforms like twitch and youtube and others, if any.
The client may or may not be notified of this.If the client demands that the piece not be posted anywhere and be kept private,a privacy fee of $20 is issued before starting the work, this should be clarified from the beginning and the artist is not held liable for any wips and posts shared anywhere prior to being told and/or the client paying the fee.In rare occasions during personal problems the maximum deadline for the work could be upto 3-4 months, during which the client will receive continual updates and potentially a discount coupon which can be used in their next commissionTroll clients who frequently change their requests, demand extra work be done quickly and rushing the process, show inappropriate behaviour and numerous rude actions, and even after the final artwork was delivered and readjusted multiple times- will have their commission forcibly finished and as per the first term (regarding how the transaction is non refundable) no refund will be issued even if the client protests. This term is held as a last resort and upto 2 warnings will be given to the client before this stage.When and if the client decides to share the piece on social media or anywhere that is public, they are required to mention, @ or simply provide the name of the artist ("jynkofist"). This term holds true even if the commission was private (having paid the privacy fee) and/or watermarkless (having paid watermark removal fee). This also holds true for both personal and commercial commissions, edited and unedited (see next term).Clients are not allowed to change, retouch, or trace the piece.
Any edits must be discussed with me.
In cases where the client intends to do any of the above, have discussed it with me, and paid a small fee which is agreed upon, then they are permitted to the agreed upon modifications and the modified art will still enforce the previous term (see previous paragraph about mentioning the artist).Clients are not allowed to use personal pieces in any monetary, or profitable way and legal actions may be taken if a client is found to do so.If a client wishes to get the psd file an insiders fee is issued [100% of the commission price] at the end of the commission after which the psd file will be given. The client is not allowed to share the psd with others and cannot claim the work as their own.Where applicable, additional fees should be paid in full when prompted. Until the fees are paid, the work on the piece is paused (except for insiders fee).Returning clients can be awarded with discount coupons which they can use on their next commission or their friend's next commission!After the art piece is finished, the client must acknowledge the end of the work and is kindly asked to provide feedback about their experience!These Terms of Service (all of the above) clearly describe what to expect when commissioning me, therefore if a chargeback is made through PayPal, the terms of service are held as concrete evidence of the right of the artist ,me (jynkofist), to fight back and keep the money.By proceeding to payment, you acknowledge and agree that you have read, accepted and agreed to these terms in full.
